The employer is prohibited from assigning sworn guards to watch over work activity. The guards may not enter the premises where work is carried out while it is being carried out, except exceptionally for specific and reasoned needs linked to asset protection. Where a guard breaches the article, the labour inspectorate asks the police authority (questore) to suspend the guard, and the prefect may revoke the licence. Violation of art. 2 is a criminal offence under art. 38.
