Italy Personal Data Protection Code (Legislative Decree No. 196/2003, amended 2018) Art. 123: Art. 123 Erase or anonymise traffic data when no longer needed, within the billing and consent limits

Traffic data of subscribers and users processed by a provider are erased or anonymised when no longer needed to transmit the communication. Traffic data strictly needed for billing or interconnection payments may be kept for up to six months (longer only for a specific dispute); use for marketing electronic communications services or providing value-added services requires the subscriber's or user's prior, revocable consent. The information notice tells the subscriber or user which traffic data are processed and for how long. Only persons authorised under art. 2-quaterdecies who handle billing, traffic management, customer analysis, fraud detection, marketing or value-added services may process traffic data, limited to what is strictly necessary, with each authorised person identifiable even for automated queries.
