No one may hinder a works council election or restrict an employee's right to vote or stand; influencing the election by threatening disadvantages or promising benefits is unlawful. The employer bears the election costs, and time spent voting, serving on the electoral board or acting as mediator under s 18a may not lead to a pay cut. Obstructing or influencing an election is a criminal offence under s 119.
