Beyond GDPR Art. 22(2)(a) and (c), a decision made purely by automated means is allowed in providing services under an insurance contract where the data subject's request is fully met, or where it applies binding fee rules for medical treatment and, if the request is not fully granted, the controller safeguards the data subject's interests with at least the right to human intervention, to express a view and to contest, and informs the data subject of these rights at the latest when notifying the partial refusal. Health data may be used with s 22(2) measures.
