A probability value about a natural person's future conduct (a score) may be used to decide on entering into, performing or ending a contract with that person only where data protection law is observed, the data used are demonstrably essential for the probability on a scientifically recognised mathematical-statistical method, the score does not rest on address data alone, and where address data are used the person was notified beforehand and this is documented. A credit agency's score on ability and willingness to pay may include claims only where the conditions above are met and the claim is unperformed and titled (final or provisionally enforceable judgment or other enforceable title), established in insolvency and not disputed by the debtor, expressly acknowledged, reminded twice in writing after maturity with at least four weeks since the first reminder, with a warning about reporting and no dispute, or arises from a contract terminable without notice for arrears where the debtor was warned about reporting.
