Germany Federal Data Protection Act (BDSG) s27: s 27 Research and statistics: balance interests, safeguard, anonymise early and separate identifiers

Special categories may be processed for scientific or historical research or statistics even without consent where necessary and the controller's interest substantially outweighs the data subject's, with s 22(2) measures. The rights under GDPR Arts. 15, 16, 18 and 21 are limited where they would make the research impossible or seriously impair it, and access does not apply where the data are needed for scientific research and providing it would take disproportionate effort. Special categories must be anonymised as soon as the purpose allows (unless the data subject's legitimate interests conflict); until then identifying features are stored separately and recombined only as the purpose requires. Publication needs consent or must be indispensable for presenting research on contemporary events.
