Germany Accessibility Strengthening Act (BFSG) S9: Importer: place only accessible products and check the manufacturer's steps first

What does S9 require?

An importer may only place products on the market that meet the ordinance requirements and only once the manufacturer has carried out the Annex 2 conformity assessment and drawn up the technical documentation, the product bears the CE marking, the instructions and safety information accompany it and the manufacturer has met its identification and contact duties. If the importer knows or has reason to believe a product does not conform it may only place it once conformity is restored and must also inform the manufacturer and the authorities; it must keep storage and transport from compromising conformity, and the manufacturer's corrective action and register duties apply to it accordingly.
