France Labour Code (Code du travail) - Employee Monitoring and CSE Consultation L2312-16 R2312-6: L2312-16 R2312-6 Run the consultation for the agreed or regulatory period before treating the opinion as given

The periods within which the CSE gives its opinion are set by agreement (L2312-19, or with the CSE by majority of its titular members) or, failing agreement, by decree; they must allow the CSE to exercise its competence usefully. On expiry the CSE is deemed consulted and to have given a negative opinion. Under R2312-6, failing agreement, the period is one month, two months where an expert is appointed, and three months where expert reports are made at both central and establishment level; under R2312-5 it runs from the employer's communication of the information or of its availability in the economic, social and environmental database.
