EU REACH Regulation (Regulation (EC) No 1907/2006) 38: Downstream users: report to the Agency before using a substance outside the supplier's scenario or under the one-tonne or PPORD exemption

What does 38 require?

Before starting or continuing a use of a substance registered upstream, a downstream user must report to the Agency where it has to prepare its own chemical safety report or relies on the below-one-tonne or PPORD exemptions, giving its identity, registration numbers, substance identity, supplier identity, a brief description of the uses and conditions and, except under the one-tonne exemption, any proposal for vertebrate testing it considers necessary, within six months of receiving the registration number. It must update the report without delay on changes and must also report where its classification of a substance differs from its supplier's. No report is needed for uses below one tonne a year, except where it relies on that exemption.
