Title V: Downstream users – EU REACH Regulation (Regulation (EC) No 1907/2006)

EU REACH Regulation (Regulation (EC) No 1907/2006) 37.4: Downstream users: prepare their own chemical safety report for uses outside the supplier's exposure scenario

What does 37.4 require?

A downstream user must prepare a chemical safety report under Annex XII for any use outside the conditions of an exposure scenario (or use and exposure category) communicated in a safety data sheet, or for any use its supplier advises against, and keep it up to date and available, within 12 months of receiving the registration number in a safety data sheet. It need not do so where no safety data sheet is required, the supplier needs no chemical safety report, its use is below one tonne a year, it implements or recommends an exposure scenario at least as protective as the one communicated, the concentration is below the Article 14(2) thresholds, or the use is PPORD with risks adequately controlled.
