EU REACH Regulation (Regulation (EC) No 1907/2006) 37.2: Downstream users: make uses known to suppliers so they can become identified uses; suppliers respond on time

What does 37.2 require?

A downstream user may make its use known in writing to its supplier, with enough information for the supplier to prepare an exposure scenario, so that it becomes an identified use; distributors pass such information up the chain. For a registered substance the supplier must carry out the Article 14 assessment for that use before its next supply, if the request came at least one month before, or within one month after the request, whichever is later. If, having assessed the use, it cannot include it for reasons of protecting health or the environment, it must tell the Agency and the downstream user in writing without delay, may not supply without including those reasons in the safety data sheet or Article 32 information, and must list the use as advised against in its registration update.
