Chapter III: FIU powers that bind obliged entities – EU Anti-Money Laundering Directive (Directive (EU) 2024/1640)

EU Anti-Money Laundering Directive (Directive (EU) 2024/1640) 25-26: Carry out FIU monitoring instructions and act on FIU alerts

What does 25-26 require?

An FIU may instruct an obliged entity to monitor, for a period it sets, transactions or activities through one or more accounts or business relationships of persons presenting a significant risk, and to report the results; it may do so for another Member State's FIU. FIUs may also alert obliged entities, for up to six months, to transaction types, specific persons or geographic areas presenting a significant risk, for use in customer due diligence, and give them annual strategic information on typologies, risk indicators and trends. The obliged entity must run the instructed monitoring, report as required and build the alerts into its due diligence and risk assessment.
