Chapter III: FIU powers that bind obliged entities – EU Anti-Money Laundering Directive (Directive (EU) 2024/1640)

EU Anti-Money Laundering Directive (Directive (EU) 2024/1640) 24: Apply FIU suspensions of transactions, accounts and business relationships at once

What does 24 require?

FIUs may urgently suspend or withhold consent to a transaction suspected of being linked to money laundering or terrorist financing, for up to 10 working days for their analysis (longer where national law gives the FIU asset tracing, seizure or confiscation functions, with court challenge available), imposing it within the period set by Article 71 of the AML Regulation where it follows a suspicious transaction report, and as soon as possible where it follows the FIU's own analysis. They may also suspend the use of a bank, payment or crypto-asset account, or a business relationship, for up to 5 working days, and may act at the request of another Member State's FIU. The obliged entity must give immediate effect to the suspension and to its lifting, which the FIU may order at any time.
