EPA Risk Management Program (40 CFR Part 68) 68.151: § 68.151 Assertion of claims of confidential business information (with 68.152 substantiation)

An owner or operator may claim CBI for information meeting 40 CFR 2.301, but may not claim as CBI: registration data (68.160(b)(1) to (6), (8), (10) to (13) and (21), and the NAICS code and program level); the OCA data on basis of results, wind speed and stability, topography, distance to endpoint and receptors; accident history data; the listed Program 2 and Program 3 prevention program data; and emergency response program data. A CBI claim requires, at submission, the claimed information in EPA's format, a sanitised copy of the RMP marked "CBI" (with a generic class name substituted for any chemical identity claimed), and substantiation meeting 40 CFR 2.301 (68.152), itself claimable as CBI only when marked (with sanitised and unsanitised versions), and a certification by the owner, operator or senior official that the signer examined the information, that it is true, accurate and complete, and that the claimed portions would reveal trade secrets or other CBI.
