Manifest discrepancies are significant differences between the waste on the manifest or shipping paper and what arrives, rejected wastes (full or partial loads the facility cannot accept) and container residues above the empty-container limits of 261.7(b) and 266.507. Significant differences in quantity are variations above 10 percent by weight for bulk waste and any variation in piece count for batch waste; in type, obvious differences found by inspection or analysis. The facility must try to reconcile a significant difference with the generator or transporter and, if unresolved 20 days after receipt, immediately submit a report describing it and the reconciliation attempts with the manifest copy, through the e-Manifest system from December 1, 2025 (paper reports no longer accepted). Before forwarding rejected waste or residues the facility must consult the generator; if no alternative facility can take it the waste may be returned to the generator; it must go within 60 days of the rejection or residue identification, with the transporter retaining custody or the facility providing secure temporary custody meanwhile. A new manifest is prepared for forwarding to an alternate facility (generator's ID and name, alternate facility in Item 8, cross-referenced tracking numbers, DOT description and quantities, the facility signing as offeror and mailing a copy to the generator) or for return to the generator (the facility as offeror, the generator as designated facility), except that a full rejection while the transporter is present may use Items 18a and 18b of the original; loads returned to the generator trigger its exception reporting. Where a rejection or residue is identified after the manifest was signed and returned, the facility amends its copy, re-signs, keeps it three years and within 30 days sends it to transporters not registered in e-Manifest.
