EPA RCRA Hazardous Waste Management 264.71: § 264.71 Use of manifest system

On receiving waste with a manifest the owner, operator or agent must sign and date each copy by hand, noting any discrepancies, immediately give the transporter at least one copy, send the top copy (Page 1) and any continuation sheet to the e-Manifest system as an image file (or data plus image file) within 30 days of delivery, and keep a copy at least three years from delivery. For waste from a foreign source under Part 262 Subpart H the facility must also enter the consent number for each waste in the International Shipments block and send the manifest to e-Manifest within 30 days, and return the signed movement document within three working days (via WIETS). Rail or water bulk deliveries with a shipping paper are signed, discrepancies noted, a copy given to the transporter, Page 1 sent to e-Manifest within 30 days and records kept three years. A facility initiating a shipment must comply with Part 262. The facility must determine whether the consignment state regulates additional wastes as hazardous and whether the consignment or generator state wants manifest copies. Electronic manifests are legally equivalent (signatures, transmission, availability during transport, retention in the facility's e-Manifest account, no liability for system-only failures) and may be used on the facility's or the transporter's equipment. For a paper replacement of an electronic manifest, the facility signs Item 20, notes discrepancies in Item 18, gives the final transporter a copy, within 30 days sends signed copies to the generator and to e-Manifest, and keeps a copy three years; pilot signature methods also need ink signatures. The facility pays the e-Manifest user fee for each manifest submitted (Subpart FF), uses signatures meeting 262.25, and must make EPA-requested data corrections within 30 days through the certified electronic correction process of 264.71(l).
