A generator must determine its category (VSQG, SQG or LQG, per the 260.10 definitions) for each calendar month, since it can change month to month. Where only acute or only non-acute waste is generated, count the month's total, subtract the waste exempt from counting, and read the category from Table 1; where both are generated, count and categorise them separately and apply the more stringent category to the accumulation and management of both. The count includes all hazardous waste except waste exempt under 261.4(c) to (f), 261.6(a)(3), 261.7(a)(1) or 261.8; waste managed immediately on generation only in on-site elementary neutralization, wastewater treatment or totally enclosed treatment units; waste recycled without prior storage in an on-site process under 261.6(c)(2); used oil under Part 279; spent lead-acid batteries under Part 266 Subpart G; universal waste under Part 273; unused commercial chemical products from a Subpart K laboratory clean-out; waste from an episodic event managed under Subpart L; and hazardous waste pharmaceuticals managed under Part 266 Subpart P or conditionally exempt as DEA controlled substances under 266.506. Waste already counted once need not be counted again when removed from accumulation, when it is the residue of on-site treatment or reclamation, or when spent materials are reclaimed and reused on site. The category fixes which independent requirements (262.10) and which accumulation conditions (262.14 to 262.17) apply. Mixing: a VSQG may mix its hazardous waste with solid waste and stay under 262.14 unless the mixture exhibits a characteristic, in which case it is newly generated waste to be counted; SQG and LQG mixtures remain subject to the mixture rule, the dilution prohibition of 268.3(a), 268.40 for de-characterised waste and 262.11, and a hazardous mixture is newly generated waste that can move the generator up a category.
