Every person who generates a solid waste (as defined in 261.2) must make an accurate hazardous waste determination: (a) at the point of generation, before any dilution, mixing or other alteration, and again whenever exposure to the environment or other factors may have changed its properties so that its RCRA classification could change; (b) first check whether the waste is excluded under 261.4; (c) if not excluded, use knowledge of the waste (origin, composition, process, feedstock, other reliable information) to decide whether it meets a listing in Part 261 Subpart D (a listed waste may be the subject of a delisting petition under 260.20 and 260.22); (d) also determine whether it exhibits a characteristic in Part 261 Subpart C, by applying knowledge of the hazard characteristic in light of the materials and processes, or by testing with the Subpart C methods or an equivalent approved under 260.21 on a representative sample where knowledge is inadequate (a properly performed regulatory test is definitive; other tests are only part of knowledge); (e) a waste found hazardous must be checked against Parts 261, 264 to 268 and 273 for other exclusions or restrictions. (f) SQGs and LQGs must keep records supporting each determination (test results, sampling and analytical methods, the process and composition records consulted, and the knowledge basis) for at least three years from the date the waste was last sent to on-site or off-site treatment, storage or disposal, extended during any unresolved enforcement action. (g) SQGs and LQGs must identify every applicable EPA hazardous waste code and, before shipping off site, mark containers with them under 262.32. A VSQG is bound by (a) to (d) only.
