EDPB Guidelines 3/2019 on Processing of Personal Data through Video Devices 5(c): 5(c) An employer must not use footage of a demonstration to identify strikers

The Guidelines give as an example of prohibited processing an employer using recordings of a demonstration to identify strikers: inferring participation in industrial action from footage is special category processing (political opinion, trade union activity) that the employer has no ground for.
