A U.S. person that receives a request (written or oral, including solicitations, directives, legends or instructions) to take any action furthering or supporting an unsanctioned foreign boycott must report it to the Department of Commerce whether or not the action is prohibited, where it knows or has reason to know the purpose is boycott-related and the request relates to U.S. commerce (or, for questionnaires, to present or anticipated business with a boycotting country); reading publications and unsolicited invitations to bid not responded to are not reportable, and listed requests (carrier flag and route, positive origin and supplier statements, general compliance with local law, individual visa information, destination statements, vessel eligibility certificates, insurer agent certificates, pre-1978 risk-of-loss clauses) are exempt. Each request is reported once per transaction by the recipient (who may designate another but remains liable), by mail or electronically on the prescribed forms, by the last day of the month after the calendar quarter of receipt (second month for U.S. persons outside the United States), stating the action intended or taken (with a follow-up within 10 business days of deciding) and attaching two copies of the relevant pages, one edited as the public inspection copy; records of reportable requests are kept for five years.
