TMP covers temporary exports: not where an order to acquire the item exists before shipment, where the item is known to stay beyond the permitted period or is for lease or rental abroad. Tools of trade (not to E:1; MT items not to D:4 or D:5) must stay under the exporter's effective control, with software protected by secure connections, passwords and firewalls; firearms as tools of trade are limited to three firearms and 1,000 rounds, for legitimate business use, declared to CBP; technology may travel with U.S. persons or their foreign person employees abroad, possessed only by authorised persons, with security precautions such as encryption, VPNs and access controls, not for foreign production or technical assistance; replacement parts kits, exhibition and demonstration (exporter ownership, effective control, 120 days per site), inspection, test, calibration and repair, containers, assembly in Mexico (return within four years), news media (with notice to BIS for sanctioned destinations), temporary exports to a U.S. person's own foreign subsidiaries (no onward transfer without authorisation) and personal protective equipment. Items must return within one year unless consumed, or be licensed for disposal, or an extension (up to four years) applied for 90 days before expiry. TMP also covers exports of items temporarily in the United States (in transit, imported for exhibitions, returns of foreign-origin items and refused entries, and firearms temporarily imported, with CBP documentation) and beta test software (free or at cost, user-installable, importer statement, destroyed or returned within 30 days of the test end, with notification for non-standard cryptography).
