AIA, as it stands in the eCFR, authorises specified advanced computing commodities, related software and technology, and 4E091 AI model weights to entities located in, and headquartered in, the destinations listed in Supplement No. 5 to Part 740, not for training 4E091 models for entities outside those destinations; model weights may also go to entities headquartered there if located outside Macau and D:5 and stored in facilities meeting paragraphs 14, 15 and 18 of the data center VEU guidelines. Before use the exporter must furnish the ECCN, obtain a one-time ultimate consignee certification (awareness of AIA, no Part 744 prohibited end uses, no IaaS access for training 4E091 models for entities outside the listed destinations, no onward transfer outside them) and submit it to BIS where cumulative TPP reaches the stated level, and notify the consignee in writing with each shipment.
