Regulations can require undertakers having apparatus in a street to pay fees to the Secretary of State for the NUAR functions (set so that, so far as possible and taking one year with another, combined income matches combined costs, with the amounts in regulations or in a published statement laid before Parliament), and to provide information to help set fees and to work out whether and how much a given undertaker must pay, notifying changes. The Secretary of State may impose a penalty for failing to pay or provide the information, or for giving materially false or misleading information, after a warning notice allowing at least 28 days for representations; penalties are payable within at least 28 days and can be appealed to the First-tier Tribunal within 28 days.
