Part 3: National Underground Asset Register and street works records – Data (Use and Access) Act 2025

Data (Use and Access) Act 2025 NRSWA.106B: Section 56: Initial upload of apparatus records into NUAR

What does NRSWA.106B require?

Before the end of the initial upload period set by regulations, an undertaker having apparatus in a street must enter into the National Underground Asset Register all information in its section 79(1) records (Article 39(1) in Northern Ireland) on the archive upload date and any other prescribed information it holds on that date, in the prescribed form and manner, except in prescribed cases. Failure is an offence (a fine on summary conviction; level 5 in Northern Ireland) and makes the undertaker liable to compensate anyone who suffers damage or loss as a result; it is a defence to show all reasonable care was taken by the undertaker, its contractors and their employees.
