Part 5: Cyber Incident Review Board – Cyber Security Act 2024 (Australia)

Cyber Security Act 2024 (Australia) 49: s 49 Produce documents to the Board within at least 14 days of a notice, civil penalty of 60 penalty units

Where the Board reasonably believes an entity involved in an incident under review has a relevant document, the Chair has first requested it under s 48 (a request nobody is obliged to meet), and the entity is not a Commonwealth or State body or their officer or employee, the Chair may by written notice require the entity to produce the document or copies within a period of not less than 14 days and in the manner specified, the notice setting out the effect of s 50, Part 6 and the Criminal Code's false-information provisions; failure to comply attracts a civil penalty of 60 penalty units, except where production would or could reasonably be expected to prejudice security, defence or international relations, intelligence capabilities, the prevention, detection, investigation or prosecution of an offence or civil penalty contravention, or the administration of justice, with the entity bearing no evidential burden on those exceptions; reasonable compensation is payable for producing copies.
