A worker may cease or refuse work on a reasonable concern that it would expose the worker to a serious risk from an immediate or imminent exposure to a hazard (s 84), and a trained HSR may direct a worker in the group to cease such work after consulting the PCBU and attempting issue resolution, or immediately where the risk is too serious and immediate to consult first, informing the PCBU (s 85). The worker notifies the PCBU and remains available for suitable alternative work (s 86). The PCBU may direct safe and appropriate alternative work at the same or another workplace until normal duties resume (s 87), and a cessation does not affect continuity of engagement for prescribed purposes unless the worker unreasonably refused suitable alternative work (s 88). Any party may ask the regulator for an inspector (s 89). The PCBU's duty is to respect the right, manage the cessation lawfully and never treat it as grounds for adverse action (Part 6).
