When a worker requests an HSR election, the PCBU facilitates the determination of one or more work groups. Work groups are determined by negotiation and agreement between the PCBU and the workers proposed to form them or their representatives; the PCBU takes all reasonable steps to start negotiations within 14 days of the request; negotiations settle the number and composition of work groups, the number of HSRs and deputies and the workplaces covered, and may later be varied. If a worker asks, the PCBU negotiates with the worker's representative and does not exclude that representative. If negotiations fail, a party may ask the regulator to appoint an inspector to decide (s 54).
