Australia Therapeutic Goods Act 1989 s42DR-42DX: Answer the Secretary's advertising or generic information substantiation notices within the period set (at least 14 days) and comply with directions to cease, retract, correct, recover or destroy advertisements or stop a claim

What does s42DR-42DX require?

Whoever appears responsible for an advertisement or for spreading generic information must supply the information and documents that a written notice from the Secretary specifies about the advertisement or dissemination within the period stated (not less than 14 days, or longer if allowed) and in the specified form; failure or false information is an offence and false information a civil penalty (sections 42DS and 42DT). Where the Secretary is satisfied there has been a contravention, the Secretary may direct the person to cease the advertisement or withdraw the information, make a retraction or correction in a specified form and for a specified period, recover material still in circulation, destroy it or stop making a particular claim, and report compliance; contravening a direction is an offence and civil penalty (sections 42DW and 42DX). Failure to answer a substantiation notice may also lead to a public warning notice.
