Australia Therapeutic Goods Act 1989
Chapter 4A and Chapter 5: vaping goods, advertising and generic information, counterfeit goods and product tampering – Australia Therapeutic Goods Act 1989

Australia Therapeutic Goods Act 1989 s42DD-42DK: Use a restricted representation (a reference to a serious form of a disease or condition identified in the Code) only with an approval or permission, include every required representation, use prohibited representations only with the Secretary's written permission, and keep to any conditions

What does s42DD-42DK require?

A representation in an advertisement that refers to a form of disease, condition, ailment or defect the Advertising Code identifies as serious is a restricted representation and needs an approval under section 42DF or a permission under section 42DK. Representations specified by regulation are prohibited representations, which may be used on labels, packages or included material only with the Secretary's written permission where necessary for appropriate use, or in advertisements only where necessary in the public interest; representations specified by regulation for particular goods are required representations that must appear. Permissions may carry conditions and are published. Using these representations outside an approval or permission or its conditions, or omitting a required representation, is a contravening provision under sections 42DL and 42DLB.
