Australia Therapeutic Goods Act 1989
Chapter 4A and Chapter 5: vaping goods, advertising and generic information, counterfeit goods and product tampering – Australia Therapeutic Goods Act 1989

Australia Therapeutic Goods Act 1989 s42DM-42DMA: Make every public advertisement for therapeutic goods comply with the Therapeutic Goods Advertising Code, noting each day of continuing non-compliance is a separate contravention

What does s42DM-42DMA require?

Publishing, or causing someone else to publish, an advertisement for therapeutic goods that breaches the Therapeutic Goods Advertising Code is an offence (5 years or 4,000 penalty units where reliance on it has caused or is likely to cause harm, 12 months or 1,000 penalty units, or 100 penalty units strict liability) and a civil penalty (up to 5,000 penalty units for individuals and 50,000 for bodies corporate). Each day the non-compliance continues is a separate offence or contravention, with a daily maximum of 10 percent of the penalty. Broadcasters, datacasters, SBS and prescribed persons have a defence if their steps made it reasonable to assume compliance.
