Chapter 3: Commonwealth companies, duties of directors, audit committee, government policy, corporate plans, budget estimates, annual reports and audit (sections 88 to 99) – Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act)

Australia Public Governance, Performance and Accountability Act 2013 (PGPA Act) 93: Government policy orders for wholly-owned Commonwealth companies: the directors must ensure compliance with any applicable order in relation to the company and, so far as practicable, its subsidiaries

What does 93 require?

The Finance Minister may make a government policy order applying an Australian Government policy to one or more wholly-owned Commonwealth companies, once satisfied that the Minister responsible for the policy has consulted the company. Where an order applies, the directors must see that it is complied with by the company and, so far as practicable, by any subsidiary. Such an order is a legislative instrument exempt from disallowance.
