Schedule 2 Division 5: Dealing with credit information (transfers, disclosures, security, use limits, fraud bans, direct marketing) – Australia Privacy (Credit Reporting) Code 2025

Australia Privacy (Credit Reporting) Code 2025 17(3)-(6): On a fraud ban request immediately notate the file, explain the ban and the options, relay additional ban requests to nominated bodies, tell enquiring providers of the ban, and notify the individual of enquiries where they use the service

When an individual who believes on reasonable grounds they are or are likely to be a fraud victim asks a body not to use or disclose their credit reporting information, the body must immediately notate the file for the duration of the ban and explain the ban's effect and duration including that credit may be unavailable, the ban notification service if offered, the right to request bans with other bodies, and the option to consent to the first body passing an additional ban request (and if relevant a notification service request) to nominated bodies; the first body must relay such requests as soon as reasonably practicable and each notified body must treat the relayed request as if made directly. When a provider or insurer requests credit reporting information on a banned file the body must tell them of the ban and its effect, and where the individual has requested the notification service the body must notify the individual of the request using the contact details provided.
