Where a provider obtains credit reporting information about an individual from a body and, within 90 days, refuses the individual's consumer credit application (alone or jointly), it must give a written notice of refusal that meets subsection 21P(2) of the Act, explains the right to free access to their credit reporting information for 90 days after the notice and how to ask the body, states that individuals should proactively check the accuracy of the information bodies hold, states that the provider relies on several sources including the individual's own information and credit reporting information from one or more bodies, describes factors often considered when refusing credit (income adequacy, indebtedness and commitments, employment security, and credit history including bankruptcy, defaults, serious credit infringements, many applications and unsatisfactory repayment history), and refers to the provider's processes for access, correction and complaints. The notice must be given when the refusal is communicated or within 10 business days.
