Employees, except those excluded under subsections 123(1) and (3) of the Act, must give notice based on continuous service: 1 week for up to 1 year, 2 weeks for more than 1 and up to 3 years, 3 weeks for more than 3 and up to 5 years, and 4 weeks for more than 5 years. Continuous service has the s 117 meaning. If an employee aged at least 18 gives less notice, the employer may withhold up to one week's wages from award wages due, but not if it agreed to shorter notice, and any deduction must be reasonable in the circumstances. Employer notice is governed by the NES (ss 117 and 123).
