Where the Commissioner is satisfied that material accessible through an internet service provider's carriage service promotes, incites, instructs in or depicts abhorrent violent conduct and that its online availability is likely to cause significant harm to the Australian community, the provider may be given a blocking request (voluntary) or a blocking notice (mandatory) to take specified steps to disable access, such as blocking domain names, URLs or IP addresses, for up to 3 months at a time (renewable). No procedural fairness is owed on giving the request or notice; where a domain name or its URL is to be blocked, a registrant known to the Commissioner is given a copy. A person must comply with a blocking notice (no capability qualifier); 500 penalty units; review by the Administrative Review Tribunal. Exempt material under s 104 (law enforcement, courts, research, public-interest journalism, public officials, advocacy, art) is outside these powers.
