Australia Online Safety Act 2021
Parts 5 to 8: Complaints-based removal, end-user notices and blocking – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s30(4)-65(1)(c): Run an in-service complaints process that resolves reports within 48 hours and issues complaint receipts

What does s30(4)-65(1)(c) require?

The Commissioner's removal notices to providers for cyber-bullying material targeted at an Australian child (s 65, 66) and cyber-abuse material targeted at an Australian adult (s 88, 89, 90) are available where the material was the subject of a complaint made to the provider and was not removed within 48 hours after that complaint (or a longer period the Commissioner allows). A complainant seeking such a notice must give the Commissioner evidence of the prior complaint in the form the Commissioner requires: the receipt or complaint number where the service issues one in its ordinary business processes, or otherwise a screen shot, statutory declaration or other specified form (ss 30(4) to (7), 36(3) to (6)). A provider that resolves in-service complaints within 48 hours and issues receipts or complaint numbers keeps these matters inside its own process.
