Australia National Disability Insurance Scheme Act 2013 s73Z-4-f: s 73Z(4)(f) Treat any restrictive practice used without State or Territory authorisation as reportable

Using a restrictive practice in relation to a person with disability other than in accordance with a State or Territory authorisation is a reportable incident. Providers must therefore know the authorisation, consent and reporting rules of each jurisdiction in which they work, obtain authorisation where required, and notify unauthorised use. The Commission's practice guides (regulated restrictive practices with children and young people, March 2021; safe transportation, February 2022) note that misuse may also need reporting to police, child protection and reportable conduct schemes.
