A person must not engage in a credit activity without an Australian credit licence that authorises it, unless acting within authority as an employee, director or credit representative of a licensee. A person must not falsely hold out that it is licensed, exempt or acting for a licensee, or advertise credit activities it could not lawfully carry on; a licensee must not do business with a person who is engaging in credit activity in breach of s 29; and no fee may be taken from a consumer for unlicensed credit activity.
