New South Wales replaces the water efficiency Performance Requirements for cold water (NSW B1P5), heated water (NSW B2P12), non-drinking water (NSW B3P8) and rainwater (NSW B6P3) and the energy clause NSW B2P8, each noting that fixtures, tapware and water heaters in new Class 1 and 2 buildings are subject to BASIX targets. It replaces NSW C2P7 (damage) and C2D4, and varies the Deemed-to-Satisfy clauses B1D2, B1D3, B2D2, B2D4, B2D5, B2D6, B2D9, B3D3, B3D5, B5D2, B5D3, B5D6, B6D4 and adds NSW B5D8 for cooling tower water services. It also supplies its own A2G2 Performance Solution, A5G3 evidence of suitability for Volumes One and Two and A5G6 fire hazard clauses. In New South Wales the national Part B4 does not apply (fire-fighting water services are regulated under the Environmental Planning and Assessment Act 1979 and its regulations, which reference the Building Code of Australia) and the national Part C3 does not apply (on-site wastewater is not the plumbing regulator's responsibility, and a domestic sewage management facility for up to 10 people or under 2000 litres a day must be accredited by the NSW Ministry of Health under the Local Government (General) Regulation 2021).
