Australia Model Code of Practice: Managing the Risk of Falls at Workplaces 1.1: 1.1 Identify every duty holder for fall risks and their overlapping duties

Several parties hold duties for fall risks at the same time. The PCBU must eliminate the risk of falls, or where that is not reasonably practicable minimise it so far as is reasonably practicable (WHS Act s 19), and must meet the specific WHS Regulations duties to do work on the ground or a solid construction, to provide safe access and exit, and otherwise to provide adequate protection through a fall prevention device, then a work positioning system, then a fall arrest system, combining controls where one is not enough. Work with a risk of a fall of more than 2 metres is high risk construction work that needs a safe work method statement (SWMS) before it starts. Designers, manufacturers, importers, suppliers and installers of plant or structures must ensure so far as is reasonably practicable that the plant or structure is without risk, including testing and supplying information (WHS Act Part 2 Division 3). Officers exercise due diligence, including understanding the hazards and making sure resources and processes exist to control fall risks (s 27). Workers take reasonable care, follow reasonable instructions, cooperate with notified policies and use PPE provided (s 28); other persons at the workplace take reasonable care and follow reasonable instructions (s 29).
