Australia Insurance Contracts Act 1984 (Cth) s39-62: ss 39 and 62 Instalment premiums: inform in writing before relying on non-payment terms

For instalment contracts of general insurance, the insurer may refuse a claim because of non-payment only if an instalment has been unpaid for at least 14 days and, before entry, it clearly informed the insured in writing of the effect of the non-payment term (s 39). It may cancel under a contract term for non-payment only if an instalment has been unpaid for at least one month and it gave the same prior written notice (s 62).
