For prescribed contracts (motor vehicle, home buildings, home contents, sickness and accident, consumer credit and travel insurance as declared in the Regulations), the insurer cannot refuse to pay at least the prescribed minimum amount for a prescribed event because the contract gives less or no cover, unless it proves that before entry it clearly informed the insured in writing (for example by giving the policy wording) of the lower limit or the absence of cover, or the insured knew or a reasonable person would have known. Questions about whether an event is prescribed are read against the insurer (s 36).
