Australia Insurance Contracts Act 1984 (Cth) s37C: ss 37A to 37E Home insurance: state in writing whether flood is covered, and apply the standard flood definition

For the classes prescribed by the Regulations (home buildings, home contents and combined home cover, strata title residence cover, and cover for the premises, equipment, stock or inventory of a small business), before entry the insurer clearly informs the insured in writing whether the contract covers loss or damage caused by flood as defined in the Regulations. The standard flood definition overrides any different meaning in the contract or related documents; if the contract covers any flood event it is taken to cover flood as defined, up to the highest maximum amount of flood cover in the contract, and the insurer cannot refuse a flood claim merely because of a narrower definition (s 37D).
