A medical practitioner who is not in a surgical class (specialist registration in surgery, obstetrics and gynaecology, ophthalmology, another specialty whose specialist title includes 'surgeon', or a class prescribed by regulation) does not knowingly or recklessly use the title 'surgeon', any title, initials, symbol or description suggesting membership of a surgical class, or claim to be a member; and no person does so about such a practitioner. Dentists and those permitted by another law to use 'surgeon' for another profession are outside the title limb. In force since 20 September 2023 (Surgeons Amendment Act 2023). Maximum penalties: $60,000 or three years' imprisonment; $120,000 for a body corporate that describes a practitioner.
