Disputes about the award or the NES must first be discussed between the employees and their supervisor, then with more senior management, and may then be referred to the Fair Work Commission, which may use any method the Act allows; parties may be supported or represented. While the procedure runs, work continues under the award and the Act and employees must not unreasonably refuse safe and appropriate directions, subject to WHS laws. The Act also has specific dispute procedures for flexible working requests (s 65B), casual conversion (s 66M), unpaid parental leave extensions (s 76B) and the right to disconnect (s 333N).
