Part 4: Franchisor obligations, agreement terms, transfer and termination – Australia Franchising Code of Conduct (Franchising Regulations 2024)

Australia Franchising Code of Conduct (Franchising Regulations 2024) s55-58: ss 55 to 58 Follow the notice rules before terminating

For a breach, the franchisor must give written notice of the proposed termination, what must be done to remedy it and a reasonable time to remedy (which need not exceed 30 days), and must not terminate if remedied. Without breach and without consent, it must give reasonable written notice and reasons. Termination for the serious grounds the Code lists (loss of licence, insolvency, serious offence, fraud and similar) needs 7 days' notice.
