Where the employee's genuine attempt to agree has failed, and has had an excessive accrual for more than 6 months without a direction that would eliminate it, they may give written notice asking to take paid annual leave in one or more periods. The notice must not leave them with less than 6 weeks' accrued leave, request a period under one week, start sooner than 8 weeks or later than 12 months from the notice, or conflict with agreed leave, and may not seek more than 4 weeks (5 weeks for a shiftworker) in any 12 months. The employer must grant leave requested by a notice that meets these conditions.
