Subject to s 62 of the Act, the employer may require reasonable overtime at overtime rates, and an employee may refuse overtime that is unreasonable. Deciding reasonableness requires considering: any health and safety risk; the employee's family responsibilities and other personal circumstances; the needs of the workplace; whether the employee is paid overtime, penalties or other compensation, or remuneration reflecting additional hours; notice the employer gave; notice the employee gave of refusing; usual work patterns in the industry or sector; the employee's role and responsibility; whether the hours accord with averaging terms of the award under s 63 (the clause refers to clause 24); and any other relevant matter.
