An employer must not discriminate against an employee on the ground of disability in the terms or conditions of employment, by denying or limiting access to promotion, transfer, training or other benefits, by dismissal, or by any other detriment. Because failing to make reasonable adjustments can itself be discrimination (s 5(2), s 6(2)), employers assess and make workplace adjustments (equipment, duties, hours, premises, communication) unless unjustifiable hardship is shown (s 21B), and rely on inherent requirements (s 21A) only after considering adjustments, the employee's training, qualifications, experience and performance.
