Australia Corporations Act 2001 (Cth) s994C: s 994C Issuers: review TMDs on schedule and stop distribution within 10 business days of a review trigger

An issuer completes a review of each TMD within the review periods the TMD specifies while the product remains on offer (offence and civil penalty), and where it knows a review trigger, or another event suggesting the TMD is no longer appropriate, has occurred, it stops retail product distribution conduct as soon as practicable and within 10 business days unless it has reviewed the TMD and, if needed, made a new one; within the same 10 business days it takes all reasonable steps to ensure distributors stop distributing (s 994C(5)), and distributors who are told stop accordingly.
